Mobile Messaging Terms and Conditions

The following Mobile Messaging Terms and Conditions (“Mobile Terms”) govern your participation in any of the text message services / Mobile Programs provided by HB Solutions Group, LLC, as well as any of our affiliates, subsidiaries, and brands who link to these Mobile Terms (collectively, “we” or “us”) as described below (the “Services”). Our brands, affiliates, and subsidiaries include Hoffmann Brothers, Blue Sky, and Ferguson. Your use of the Services constitutes your agreement to these Mobile Terms. We may modify or cancel the Services or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Services following the effective date of any such changes shall constitute your acceptance of such changes.
We offer the Services through two types of SMS programs: (1) the marketing messaging program; and (2) the transactional messaging program. You can participate in one or both programs. We offer the Services to individuals who would like to receive marketing (such as offers, discounts, promotions, etc.) and/or transactional (such as appointment reminders, dispatch notifications, etc.) text messages from and related to us. Our marketing SMS program may send messages offering coupons or discounts, or alert you about sales, promotions, or other offers. Our transactional SMS program will send you messages about your order, service appointment, or details about products or services that you request from us. You may opt-in to receive messages from either or both of these programs depending on your preference.

To participate in the marketing mobile program and receive mobile alerts and offers from the applicable HB Solutions Group, LLC brand, affiliate, or entity you wish to receive marketing messages from, submit your mobile number through the applicable webform, or provide your consent verbally through a conversation with your technician or customer service representative. You will receive recurring marketing messages from the applicable HB Solutions Group LLC brand, affiliate, or subsidiary that you consent to receive messages from at the phone number from which you sent the reply message. Our marketing SMS program messages may be sent using an automated dialing system. You are not required to consent to receive mobile messages to purchase goods or services from HB Solutions Group, LLC, or any of our brands, affiliates, or subsidiaries. Messaging frequency may vary.

To participate in the transactional mobile program and receive transaction-related mobile alerts from the applicable HB Solutions Group, LLC brand, affiliate, or entity you wish to receive transactional messages from, submit your mobile number through the applicable webform, or provide your consent verbally through a conversation with your technician or customer service representative. The Services are provided as a free service. However, message and data rates may apply from your wireless carrier depending on your cellular subscription agreement. You are responsible for all applicable costs and taxes. Consult your wireless carrier regarding their pricing plans. To stop receiving marketing messages at any time, text STOP to any marketing message you receive from us. We operate multiple mobile programs, as indicated by the short code. Opting in or out of one SMS program will not opt you in or out of other SMS programs, or any other communications from us. Any messages you send in text messages become our property. No remuneration is implied or offered. News and data delivered are believed to be accurate at the time of delivery. We may change any short code or telephone number we use to operate the Services at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The Services for 720-923-2161 are administered by a third party service provider, which will use your information solely to deliver this mobile service in accordance with our Privacy Policy. The wireless carriers participating in this campaign are Sprint, Boost, Virgin, AT&T, U.S. Cellular, Verizon Wireless, Cricket, nTelos, Cellcom, Cspire, Carolina West, T-Mobile, Cincinnati Bell, MetroPCS, Appalachian Wireless, Alltel, Interop Carrier Group (Cellular One of East Central Illinois, Element Mobile, Golden State Cellular, Thumb Cellular, ACS/Alaska, Bluegrass Cellular, iWireless, GCI, Illinois Valley Cellular, Immix/Keystone Wireless, Inland Cellular, Nex-Tech Wireless, Plateau Wireless, Viaero Wireless, Cellone Nation, Chat Mobility, Northwest Missouri Cellular, SRT Wireless, Aio Wireless, WCC, Flat Wireless/ClearTalk Wireless, Panhandle Telecommunications, Cablevision), and Clear Sky Carrier Group (Union Cellular, Pioneer Cellular, DTC Wireless, Chariton Valley, MTA, Duet, Mobi PCS, Peoples, Mosaic Telecom, RINA Wireless, Pine Cellular, Epic Touch, Bandwidth, United Wireless, Sagebrush Cellular/ Nemont, Mobile Nation/SI Wireless, Leaco). If your wireless carrier is not participating, you will not receive a reply to your messages. Check with your wireless carrier to see if SMS messaging services are available for participation on your individual wireless plan. If you are a pre-paid user, check with your wireless carrier to see if you are able to participate. Individuals between age 13 – 18 must obtain parental consent to participate.
The wireless carriers supported by the Services are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number to continue participating in the program.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Services, any errors in such information, and/or any action you may or may not take in reliance on the information or Services. You understand that anyone with access to your mobile phone may be able to view the messages you receive when using the Service, and you agree that we will not be liable to you if this occurs.
Our use of your personal information collected and used to provide the Services is governed by our Privacy Policy.
Release of Claims; No Warranties
By participating in the Services, you agree to release and hold harmless HB Solutions Group LLC, our SMS vendor, and the participating wireless carriers and each of the foregoing’s, including HB Solutions Group LLC’s, respective subsidiaries, affiliates, representatives, agents, successors, assigns, employees, officers and directors (together, the “Released Parties”), from any and all liability, loss, harm, damage, injury, cost and expense whatsoever, including, without limitation, property damage, personal injury and death, which may occur in connection with the Services, and from any claims based on violation of law or infringement or violation of any rights of any person or entity, including, without limitation, violation of publicity rights, defamation and invasion of privacy. Released Parties are not responsible for any printing, typographical, mechanical or other errors in associated promotional materials in connection with these Services. Participating wireless carriers and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees are not responsible for these Services, and none of them will have any liability or responsibility for any claim arising in connection with participation in these Services.
The Released Parties make no warranties, and hereby disclaim any and all warranties, express or implied, concerning any offer furnished by third parties in connection with these Services. Without limiting the generality of the foregoing, all Services are provided “as is” without warranty of any kind, either express or implied, and the Released Parties hereby disclaim all such warranties, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
The Released Parties are not responsible for the following: technical, hardware, software, electronic, network, telephone or other communications malfunctions; errors or failures of any kind; errors in transmission; traffic congestion, lost or unavailable network connections, telephone connections, wireless phone connections; website, Internet, or ISP availability; unauthorized human intervention; incomplete or inaccurate capture of entry information (regardless of cause); failed (undelivered), incomplete, garbled, jumbled or delayed transmissions; any other matter that may limit or restrict your ability to send a message; any injury or damage to your or any other person’s wireless device relating to, or resulting from, participation in these Services. If you elect to communicate with our Customer Experience team by sending a mobile/text message to 720-923-2161, you will receive a response by mobile/text message to the phone number you used to send the message. This is a free service. However, message and data rates may apply from your wireless carrier. Campaign Registry Compliance
We will not disclose text message opt-in, consent, or origination information we collect from you to any third parties, such that the third party would be able to re-use your opt-in or consent to receive messages from us for their own consent to send you messages. We may disclose phone numbers to third party service providers, such as those service providers who help us run our campaigns, as described in our Mobile Terms and Privacy Policy.
