Mobile Messaging Terms and Conditions

The following Mobile Messaging Terms and Conditions (“Mobile Terms”) govern your participation in the text message services provided by Blue Sky Plumbing, Heating, Cooling & Electric (“Blue Sky,” “we,” or “us”) as described below (the “Services”). Blue Sky is a brand of HB Solutions Group, LLC. Your use of the Services constitutes your agreement to these Mobile Terms. We may modify or cancel the Services or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Services following the effective date of any such changes shall constitute your acceptance of such changes.

1. Program Description

Blue Sky offers two types of SMS programs: (1) a marketing messaging program and (2) a transactional messaging program. You may participate in one or both programs.

Marketing Program: Messages may include promotional offers, coupons, discounts, seasonal specials, and information about Blue Sky’s products and services.

Transactional Program: Messages relate to your service appointments, job status updates, dispatch notifications, appointment reminders, and other communications directly related to services you have requested from Blue Sky.

2. Consent and Opt-In

To participate in either program, you may provide your mobile number through one of the following methods:

  • Submitting your mobile number through a web form on our website
  • Providing verbal consent during a conversation with a Blue Sky technician or customer service representative

You are not required to consent to receive mobile messages as a condition of purchasing goods or services from Blue Sky. Our SMS programs may use an automated dialing system. Messaging frequency may vary.

3. Message Frequency and Rates

Message frequency varies based on your interactions with Blue Sky and your service activity. Message and data rates may apply depending on your wireless carrier and cellular subscription plan. You are responsible for all applicable costs and taxes. Please consult your wireless carrier for details on their pricing plans.

4. How to Opt Out

You may stop receiving messages from either program at any time by replying STOP to any message you receive from us. You may also text STOP directly to any of the numbers listed in Section 8 below. Opting out of one program does not opt you out of the other. Each program requires a separate opt-out.

6. Privacy Policy

Our use of your personal information, including mobile numbers collected through these programs, is governed by our Privacy Policy, available at www.blueskyplumbing.com/blue-sky-privacy-policy/. We will not share, sell, or disclose your text message opt-in data or mobile number to any third party for their own marketing purposes.

7. Supported Carriers and Carrier Liability

Participating wireless carriers include, but may not be limited to: AT&T, Verizon Wireless, T-Mobile, Sprint, Boost, Virgin Mobile, U.S. Cellular, Cricket, MetroPCS, Cincinnati Bell, nTelos, Cellcom, C Spire, Carolina West, Appalachian Wireless, Interop Carrier Group members (including Cellular One of East Central Illinois, Element Mobile, Golden State Cellular, Thumb Cellular, ACS/Alaska, Bluegrass Cellular, iWireless, GCI, Illinois Valley Cellular, Immix/Keystone Wireless, Inland Cellular, Nex-Tech Wireless, Plateau Wireless, Viaero Wireless, Cellone Nation, Chat Mobility, Northwest Missouri Cellular, SRT Wireless, Aio Wireless, WCC, Flat Wireless/ClearTalk Wireless, Panhandle Telecommunications, and Cablevision), and Clear Sky Carrier Group members (including Union Cellular, Pioneer Cellular, DTC Wireless, Chariton Valley, MTA, Duet, Mobi PCS, Peoples, Mosaic Telecom, RINA Wireless, Pine Cellular, Epic Touch, Bandwidth, United Wireless, Sagebrush Cellular/Nemont, Mobile Nation/SI Wireless, Leaco).

If your wireless carrier is not listed, you may not receive a reply to your messages. Check with your carrier to confirm SMS availability on your plan. Pre-paid users should confirm eligibility with their carrier. Wireless carriers are not liable for delayed or undelivered messages.

Individuals between the ages of 13 and 18 must obtain parental consent to participate in these programs.

You may receive SMS messages from the following numbers:

We may change any telephone number used to operate the Services at any time and will notify you of these changes. You acknowledge that STOP or HELP requests sent to a number we have changed may not be received, and we are not responsible for honoring requests made to outdated numbers.

9. Use Limitations and Acceptable Use

The Services are provided as a free service; however, standard message and data rates may apply. Any content you send to us via text message becomes our property, and no remuneration is implied or offered. You agree to provide a valid mobile number and to update your number with us if it changes. You are responsible for ensuring that any person who has access to your mobile device understands that they may be able to view messages you receive. We are not liable if this occurs.

You agree not to use the Services for any unlawful purpose or in any manner inconsistent with these Mobile Terms.

10. Limitation of Liability and Disclaimers

By participating in the Services, you agree to release and hold harmless Blue Sky Plumbing, Heating, Cooling & Electric, HB Solutions Group, LLC, our SMS vendor, participating wireless carriers, and each of their respective subsidiaries, affiliates, representatives, agents, successors, assigns, employees, officers, and directors (collectively, the “Released Parties”) from any and all liability, loss, harm, damage, injury, cost, or expense arising in connection with the Services.

The Released Parties are not responsible for: technical, hardware, software, electronic, network, telephone, or other communications malfunctions or failures; errors in transmission; traffic congestion; lost or unavailable network or wireless connections; website or ISP availability; unauthorized human intervention; incomplete or inaccurate capture of message information; failed, incomplete, garbled, or delayed transmissions; or any other matter that may limit or restrict your ability to send or receive a message.

ALL SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Modifications to These Terms

We reserve the right to modify or cancel the Services or these Mobile Terms at any time. We operate multiple mobile programs; opting in or out of one program will not affect your participation in other programs or other communications from Blue Sky. To the extent permitted by applicable law, your continued use of the Services following the effective date of any changes constitutes your acceptance of the updated terms.

12. Colorado Privacy Act

If you are a resident of Colorado, you have certain rights under the Colorado Privacy Act (CPA), C.R.S. § 6-1-1301 et seq., with respect to your personal data, including data collected through your participation in these SMS programs. These rights include:

  • The right to access the personal data we have collected about you
  • The right to correct inaccurate personal data
  • The right to delete personal data you have provided to us or that we have collected about you
  • The right to obtain a copy of your personal data in a portable format
  • The right to opt out of the processing of your personal data for purposes of targeted advertising or the sale of personal data

Your SMS opt-in data, mobile number, and consent information will not be sold to third parties or used for targeted advertising by third parties. This data is used solely to deliver the Blue Sky mobile messaging programs described in these Mobile Terms.

To exercise any of your rights under the Colorado Privacy Act, please submit a request using one of the methods listed in the Contact Us section below, or refer to the full instructions in our Privacy Policy at www.blueskyplumbing.com/blue-sky-privacy-policy/. We will respond to verified requests within 45 days, with the option to extend by an additional 45 days where reasonably necessary. If we deny your request, you have the right to appeal, and if your appeal is denied, you may contact the Colorado Attorney General’s office.

13. Campaign Registry Compliance

We will not disclose your text message opt-in, consent, or origination information to any third party in a manner that would allow that third party to use your opt-in or consent to send you their own messages. We may disclose phone numbers to third-party service providers who assist us in operating our SMS programs, as described in our Privacy Policy.
